Credit Counseling and Bankruptcy

Credit counseling is regarded as an integral part of Bankruptcy. It is as a matter of fact mandatory that you complete a briefing with a certified credit counseling agency which has been approved by the US trustees office.

This law has been in effect since 2005 and failure to complete this counseling 180 days prior to filing for bankruptcy will result in an outright dismissal of your chapter 7 and chapter 13 bankruptcy. A certificate of completion is often awarded after you have complete the counseling and this is what you must attached to your bankruptcy petition.

The sessions are often completed either online, in person or over the phone. The basic composition of credit counseling briefing will include your personal finance situation, a personal budget plan and discussions of alternatives to bankruptcy if there is any.

Generally , there are some few exceptions to the requirement that a debtor completes a credit counseling session especially prior to filing for bankruptcy. It is important to note that a bankruptcy lawyer has little or no power to waive these requirements . It is therefore important for your to discuss with your Attorney prior to filing for bankruptcy.
